Real Estate Law

The real estate closing for the purchase or sale of a property is a vital component of the transaction. When such a large amount of money is involved, you want to ensure that your interests are your lawyer's top priority and that you are in the hands of capable, honest attorneys who have the experience to handle the job. The team at J. Terry Laws, Attorney, LLC has handled thousands of real estate closings during the last 30 years, throughout all areas of South Carolina, and has developed a proficiency and integrity that makes the firm a valuable asset to conscious consumers. Whether you are purchasing or refinancing a residential, commercial or industrial property, think of your real estate attorney as your guide and leader of the closing — he or she has done the background work necessary to ensure that your interests and investment are protected in a smooth transaction and comes to the table with a solid plan that meets the needs of all parties.

Wondering what to expect at your real estate closing and what your attorney will be responsible for completing prior to closing?

  • Your attorney will research the taxes, assessments and other charges on the property.
  • He will order any insurance binders and mortgage payoff information.
  • He will examine the title for any issues that would prevent you from getting good title to the property and will clear up any issues before you buy.
  • He will coordinate title insurance.
  • A closing date will be chosen that works for all parties and the attorney will prepare the settlement statement and work with the lender to get all necessary loan documents ready for closing.
  • The buyer will come to the closing with immediately available funds, either by certified check or wire transfer.
  • Both parties will sign the necessary paperwork to finalize the sale.
  • The attorney then re-examines the title to the property and if nothing has happened to it he records the deed and distributes funds to the proper payees, including the seller, and the payoff to the seller's old lender.

Attention to detail is mandatory for any attorney handling a real estate closing. You want to be sure if an issue arises prior to closing, you are working with an attorney and staff who are seasoned and have the knowledge resolve the issues and act as your partner and guide.
